CERC Issues First Amendment Conduct Of Business Regulations, 2025

The Central Electricity Regulatory Commission (CERC) on April 11th 2025 has notified the Central Electricity Regulatory Commission (Conduct of Business) (First Amendment) Regulations, 2025, amending key provisions in its 2023 regulatory framework. The notification, issued under the Electricity Act, 2003, comes into effect from the date of its publication in the Official Gazette.

Key Changes Introduced:

Amendment to Regulation 60 – Member Entitlements

  • Clause (9) of Regulation 60 has been substituted.
  • Members of the Central Advisory Committee will now receive:
    • Travel Allowance (TA), Daily Allowance (DA), accommodation, and taxi fare equivalent to that of a Secretary to the Government of India.
    • Honorarium of ₹15,000 per meeting for members not employed by the Central/State Government or any Public Sector Enterprise.
  • The Commission retains the authority to revise the honorarium via future notifications.

Insertion of Regulation 60A – Expert Participation Framework

A new provision, Regulation 60A, has been introduced to formalize participation of experts and persons of eminence in CERC activities:

  • Experts may be invited to join Expert Committees or contribute to Consultation Processes under the Electricity Act.
  • Eminent persons may be invited to seminars or deliver lectures organized by CERC.
  • CERC will separately notify the TA/DA, accommodation, taxi fare, and honorarium for such participants.

Significance:

This amendment reflects CERC’s effort to:

  • Enhance transparency and fairness in compensations for non-governmental committee members.
  • Encourage expert involvement and public consultation by institutionalizing participation and remuneration frameworks.

Effective Date : The Regulations shall come into force from April 11th 2025
