Haryana Sets New Night Shift Rules for Women Employees

In a significant move to enhance the safety and welfare of women employees, the Haryana Government has issued a fresh notification dated May 8, 2025, laying out strict conditions under which women can be employed during night shifts (8:00 PM to 6:00 AM) in specific commercial establishments.

The notification, issued by the Labour Department, supersedes all previous guidelines and is applicable to IT, ITeS, banking, 3-star and above hotels, 100% export-oriented units, and logistics and warehousing establishments registered under the Punjab Shops and Commercial Establishments Act, 1958.

Key Highlights of the Notification:

Mandatory Prior Application:


Employers must apply for exemption at least one month before the proposed night shift period.

Validity of Exemption:


Exemptions are valid for one year, subject to no changes in key security or managerial arrangements.

Strict Compliance with POSH Act:


Employers must implement all provisions of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, and submit annual returns accordingly.

Written Consent Required:


Consent from each woman employee to work night shifts must be obtained and declared.

Improved Infrastructure and Security:


Proper lighting inside and around the workplace, deployment of security guards, and availability of female security personnel are mandatory.

Transport and Safety Measures:


Employers must offer transportation with trained drivers, security, GPS, and CCTV-equipped vehicles. Women may opt out with written consent.

Group Employment Norms:


Women must be employed in groups of at least four. However, exceptions apply to senior women professionals in IT/ITeS sectors.

Medical Support:


Emergency medical facilities must be available, either on-site or through tie-ups with local hospitals.

Exclusive Lodging:


If accommodation is provided, it must be exclusive for women and supervised by female wardens.

Labour Law Compliance:


All other applicable labour laws including ESI and the Haryana Labour Welfare Fund provisions must be complied with.
