Nagaland Issues New Expansion To Casual Employee Definition Under Law

The Government of Nagaland has issued a landmark notification expanding the definition of Casual Employees under the Nagaland Work-charged and Casual Employees Regulation Act, 2001. As per the notification all Contingency, Fixed, and Wage paid employees appointed on or before June 6, 2016, will now be deemed as Casual Employees.

📜 Key Highlights:

  • The inclusion is made under sub-section 4(b) & (c) of Chapter III of the 2001 Act.
  • The affected employees will now fall under the jurisdiction of the Work Charged and Casual Employees Commission.
  • They will be eligible for all schemes and provisions available to Casual Employees under the Act.

🔍 Verification & Regularisation:

  • A verification process will be initiated under the direction of the Commission.
  • Verified employees will be considered for regularisation and absorption under Clause 1(i) and (iii) of the 2015 Scheme for Regularisation and Absorption (OM No. AR-3/GEN-201/2009 dated March 17, 2015).
  • Employees will also benefit from the wage revision provisions notified in the same scheme.

This move is expected to bring greater job security and benefits to hundreds of workers previously employed in precarious wage-based roles, marking a significant step towards equitable employment in the state.
