Punjab Allows Shops to Open 365 Days Till May 2026

In a significant move aimed at enhancing commercial flexibility, the Government of Punjab has extended its previous decision allowing all shops and commercial establishments to remain open all 365 days of the year for another one-year period, up to 31st May 2026.

The Labour Department of Punjab issued notification under the Punjab Shops and Commercial Establishments Act, 1958, granting this exemption with a strong focus on employee welfare, safety, and compliance with labor laws.

Key Highlights of the Notification:

  • Validity: Permission is valid from the publication date in the Government Gazette until 31st May 2026.

  • Weekly Rest: Every employee must get one weekly holiday without wage deduction. A monthly holiday schedule must be displayed on the notice board.

  • Working Hours:
    • Maximum 10 hours/day or 48 hours/week.
    • One-hour break after 5 hours of continuous work.
    • Spread-over of work should not exceed 12 hours per day.

  • Night Operations: If establishments operate after 10 PM, proper safety and security measures must be ensured for both employees and visitors.

  • Women Employees:
    • Not allowed to work after 8 PM without written consent.
    • Must have lockers, security, and restrooms.
    • Safe transport to home must be ensured.
    • An Internal Complaint Committee is mandatory under the Sexual Harassment Act, 2013.

  • Child Labor: Strict adherence to the Child and Adolescent Labour (Prohibition and Regulation) Act, 1986 is required.

  • Wages & Holidays:
    • Payment (including overtime) to be credited directly to bank accounts.
    • Employees must receive national and festival holidays with pay.

  • Staffing: New staff should be recruited to cover extended hours.

  • Consent & Records: Employee consent letters for working under the new conditions must be maintained.

Enforcement:

The government warned that non-compliance with these conditions or the relevant laws could result in cancellation of the exemption, following a hearing with the competent authority.

This move is seen as a step towards economic expansion, while maintaining a firm commitment to employee rights and workplace safety.
