In a major policy move aimed at boosting business activity and customer convenience, the Government of Tamil Nadu has announced that all shops and establishments employing 10 or more people will be allowed to operate 24 hours a day, 7 days a week for a three-year period, starting from June 5, 2025.
The notification, issued by the Labour Welfare and Skill Development Department on May 8, 2025, comes under the powers conferred by Section 6 of the Tamil Nadu Shops and Establishments Act, 1947. However, the exemption from usual working hour restrictions comes with a set of strict employee welfare conditions to ensure fair treatment and safety of workers.
🔑 Key Highlights of the 24×7 Operational Exemption:
Weekly Holiday:
Every employee must get one weekly holiday on a rotation basis. This must be recorded in Form S and displayed prominently at the workplace.
Daily Leave Info Display:
Employers must display the list of employees on holiday or leave each day.
Wage Payment:
All wages, including overtime, must be credited to employees’ savings bank accounts.
Work Hour Limits:
- Daily: Max 8 hours (normal), 10.5 hours including overtime
- Weekly: Max 48 hours (normal), 57 hours including overtime
Penal Action:
Employers found violating overtime norms or making employees work on holidays without authorization will face penalties.
Women Employees – Safety & Consent:
- No work beyond 8:00 PM unless the woman employee gives written consent.
- Safe transport must be arranged for women working late.
- A notice about transport availability must be displayed at the entrance.
Amenities:
Employers must provide restrooms, washrooms, lockers, and other basic facilities.
Internal Complaints Committee:
Required under the Sexual Harassment of Women at Workplace Act, 2013 for all establishments employing women.
Compliance & Inspections:
Violations of any of the above rules or statutory provisions will attract penal action under the relevant Acts and Rules.
