In a progressive move to bolster women’s safety at workplaces, the Government of Tamil Nadu has issued a detailed Standard Operating Procedure (SOP) to effectively implement the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013—commonly known as the POSH Act.
The SOP, approved by the Social Welfare and Women Empowerment Department under G.O. (Ms) No.64 dated 18th June 2025, aims to eliminate ambiguity in the application of the law and ensure strict compliance across all departments, offices, and establishments in the state.
Key Highlights of the SOP
- Clear Roles & Responsibilities:
District Collectors continue to function as District Officers, while the Commissioner of Social Welfare serves as the State Nodal Officer to oversee POSH implementation. - Comprehensive Scope:
The SOP outlines responsibilities related to:- Prevention of sexual harassment
- Formation of Internal Complaints Committees (ICCs)
- Complaint redressal procedures
- Inquiries and recommended actions
- Annual statutory filings
- Focus on Awareness & Clarity:
The SOP responds to continuing confusion among stakeholders—even a decade after the POSH Act was enacted—by providing step-by-step guidance for grievance redressal and compliance.
Legal Mandates & Penalties
To ensure accountability, the SOP reiterates Section 26 of the POSH Act, detailing penalties for non-compliance:
- ₹50,000 fine for:
- Failing to constitute an ICC
- Ignoring ICC recommendations
- Failing to file an annual report
- Violating the Act or Rules
- On repeated violations:
- Fine increases to ₹1 lakh
- Cancellation or non-renewal of licenses or registrations of the employer or establishment
Commitment to Women’s Rights
Grounded in Articles 14, 15, and 21 of the Indian Constitution and aligned with international obligations under the UN CEDAW, the SOP underscores that a safe workplace is a woman’s legal right. The Tamil Nadu government aims to create an enabling work environment where women feel safe, supported, and confident to pursue their careers.
