Compliance under Puducherry Factories Act made online

The Labour Department of Puducherry through a notification dated 8th August, 2019 has published Puducherry Factories (Amendment) Rules, 2018.

Key highlights of the amendment:

  1. A web portal has been launched through this amendment in which applications for submission of plans, application for renewal in Form No.2, application for amendment of licence, transfer of licence and filing of Returns can be done.
  2. Payment of fees for scrutiny of plan, fee for registration and grant of license and fees to be paid for medical examinations shall be made through the online payment portal.
  3. The Rule 6(3-A) related to “Renewal of licence” has been substituted. The occupier of a factory may opt to remit the licence fee for obtaining initial licence or renewal of licence for a period up to fifteen consecutive calendar years instead of getting it renewed every year. The occupier shall make a specific request in Form No. 2 indicating the number of years for which licence is sought for. In such cases, the fee payable for grant of or renewal of licence of a factory shall be proportionate to the annual fee as per multiplied by number of years for which licence is sought for.
  4. Through this Amendment, a new rule 118A relating to “Maintenance of Register” has been inserted according to which manager/ occupier of the factory shall maintain all the books, registers and records in electronic form. The Inspector may require the production of books, registers and other documents maintained in electronic form.
