The Ministry of Health and Family Welfare (“MOHFW”) in consultation with the Drugs Technical Advisory Board has specified the devices intended for use in human beings for internal or external use in the diagnosis, treatment, mitigation or prevention of disease or disorder in human beings or animals, to be included in the definition of drug under the Drugs and Cosmetics Act, 1940.
Following devices will be specified as drugs:
(i) Nebulizer;
(ii) Blood Pressure Monitoring Devices;
(iii) Digital Thermometer; and
(iv) Glucometer
The Ministry has released the notification on 3rd December, 2018. This revised definition will come to effect from 1st January, 2020.
