Draft Surrogacy (Regulation) Amendment Rules, 2025

The draft Surrogacy (Regulation) Amendment Rules, 2025 introduce specific procedures regarding the payment, utilization of registration fees, and the detailed manner of renewing a Surrogacy Clinic’s Certificate of Registration under the Surrogacy (Regulation) Rules, 2022.

Registration Fee Payment and Utilization

The new rules establish the following procedures for the initial registration fee:

  1. The fee for the registration of a Surrogacy Clinic shall be deposited in a bank account opened in the name of the official designation of the appropriate authority concerned.
  2. The fee shall be utilized by the appropriate authority in connection with activities related to the implementation of the provisions of the Act and the rules made thereunder.

Renewal of Certificate of Registration

The draft rules detail a comprehensive process for the renewal of a Surrogacy Clinic’s certificate, including timelines, fees, and the process of approval:

Application Process and Fee

An application for renewal must be made by the Surrogacy Clinics in Form-3 to the Appropriate Authority through the National Registry Portal at least 60 days before the date of expiry of the current certificate.

The application must be accompanied by a non-refundable fee of 1 lakh rupees. If the application is not received within the 60-day period before expiry, the clinic will be required to pay the initial registration fee of 2 lakh rupees.

Establishments in Government-run institutes need not pay any fee for the renewal of the certificate of registration.

The renewal fee shall be deposited in a bank account opened in the name of the official designation of the appropriate authority and utilized for implementation activities.

After online submission, a PDF printout of the filled-in application, duly signed by the authorized signatory, must be submitted to the appropriate authority of the respective State Government or Union territory Administration. The application is only considered received from the date the prescribed fee, along with the PDF copy, is received by the appropriate authority.

Approval and Validity

Upon receiving the application, the appropriate authority shall take action within a period of 60 days.

The authority will renew the certificate (in Form 4) after inspection and upon satisfying itself that the applicant has complied with all requirements under the Act and rules.

An application may be rejected for reasons recorded in writing if it does not conform to the provisions of the Act or rules, provided that no application shall be rejected without giving an opportunity of being heard to the applicant. If a renewal application is rejected, no fee is required to be paid on re-submission if the clinic subsequently complies with the provisions of the Act or rules.

Intimation regarding the renewal or rejection must be made to the State Board.

The renewed certificate is valid for a further period of 3 years from the date of expiry of the previously granted certificate. It must also must be displayed at a conspicuous place at the clinic’s place of business.
