ESIC Issues notice on registration of employees within 10 days from the date of appointment

The Employees State Insurance Corporation in its Notification dated 3rd December 2019 has clarified and approved certain steps to be followed by the employers to register their employees within 10 days from the date of appointment.

ESIC in its earlier Circular dated 21st November 2019 has put an bar on registering any employee with appointment date which is more than 10 days prior to the date of online registration. An insurance number will be generated if the appointment is made within past 10 days and in case if the appointment is made before past 10 days the insurance number will not be generated but only an approval of concerned RO/SRO will be sent through email.

Based on the above restriction ESIC has been receiving representation from employers indicating their inconvenience. Therefore ESIC, in order to resolve the issue, approved the following:

The system allows registration of employees where difference between the date of appointment and date of registration is more than 10 days. A pop-up message will be displayed where the employer shall either accept or reject the conditions for registration of an employee. Insurance number will be allotted if the employer accepts the pop-up message and a show cause notice shall be issued to the employer. In case of rejecting the message the system will re-direct to change of date of appointment.

The employer shall submit a reply to the show cause notice within 15 days and the employer shall provide the relevant documents within stipulated time and the regional director shall either accept or reject the date of appointment. In any case date appointment shall not be earlier than 1st day of previous contribution period.
