FSSAI Issues clarification on Rectification process for cases of minor labeling defects.

The Food Safety and Standards Authority of India(FSSAI) in its letter dated 17th January 2020, has issued a clarification on the process to be followed by the food safety authority while perceiving a need for rectifying minor labeling defects on food products.

FSSAI in its earlier notification dated 17th July 2018 has advised that in cases of minor labeling defects without any food safety concern, only an improvement notice has to be issued instead of initiating adjudication proceedings against concerned FBO.

The labeling defects for which compliance measure shall be initiated was been categorized into exceptions (minor labeling defect of insignificant nature and without any food safety concern) and mandatory cases (against which adjudication action would be taken).

Therefore through this notification FSSAI has advised the state and UT enforcement agencies to take action under Section 32 of the FSS Act in cases of minor labeling defects that do not jeopardize food safety.
