The Ministry of Commerce and Industry has issued the Boilers (Appeal and Revision) Rules, 2025, which establish the detailed procedures for filing appeals and revisions against orders passed under the Boilers Act, 2025. These new rules came into force upon their publication on October 17, 2025, and supersede the former Boiler Appeal Rules, 2013.
The regulations define the authorities responsible for adjudication and set clear timelines, fee structures, and presentation methods for all grievances related to decisions made by the Chief Inspector or Inspecting Authority.
Appellate and Revisional Authorities
The new rules centralize the review process by designating a single authority for both appeal and revision. The Technical Adviser is designated as both the Appellate Authority and the Revisional Authority for the purposes of Sections 25 and 26 of the Act.
Procedures for Appeal
An Appeal addresses orders passed by the Chief Inspector or an Inspecting Authority under sub-sections (1) and (2) of Section 25 of the Act.
An appeal must be preferred to the Appellate Authority within a period of thirty days from the receipt of the order. The appeal must be submitted in Form-I, either personally, by speed post, or by e-mail. Every appeal must be accompanied by a fee of ₹ 5000 (Rupees Five thousand only), payable via crossed demand draft or through the Bharat Kosh portal.
The Appellate Authority shall fix a date for hearing within one month from the date of receiving the appeal.
Procedures for Revision
A Revision addresses orders passed by the Appellate Authority under the Act.
An application for revision must be filed within a period of sixty days from the receipt of the Appellate Authority’s order. The revision application must be submitted in Form-II, either personally, by speed post, or by e-mail. The fee for a revision application is also ₹ 5000 (Rupees Five thousand only), payable in the same manner as the appeal fee.
The Revisional Authority has the power to call upon experts or consultants from the field of boilers or boiler ancillaries to assist during the hearing. If the Appellate Authority finds it necessary, it may direct the presence of the Chief Inspector or Inspecting Authority during the hearing.
The rules emphasize that any order authorizing the grant or renewal of a certificate is subject to the payment of all applicable fees.
