Government of Madhya Pradesh amends various labour laws to boost industries and labourers

The Government of Madhya Pradesh vide its Notification dated 5th May 2020 has amended various labour laws to provide industries relaxations from departmental inspections, to exempt them from maintaining registers and to allow them to change shifts at their convenience.

The Government has proposed amendments to the Contract Labour (Regulation and Abolition) Madhya Pradesh Rules, 1973, Factories Act, Madhya Pradesh Industrial Relations Act and Industrial Disputes Act.

Under the Contract Labour Rules, the following provisions have been inserted/Substituted.

Amended Rule 21(1) reads as “the procedure for making an application for a licence shall be made in triplicate in Form No. IV  and the Validity of the Licence which is granted under rule 25 (Forms and terms and conditions of licence) or renewed under rule 29 (Renewal of Licence) shall be valid for the period of the contract for which the application is made.”

The Madhya Pradesh Industrial Employment (Permanent Order) Act, 1961, will exempt factories employing up to 100 workers from the provisions of the Act and “will make workers faithfully cooperate with production’’

The state has also exempted new factories under the Factories Act, 1948 from departmental inspection and gave them the flexibility to conduct third party inspections at will.

Under the Shop and Establishment Act 1958, the amendment states that any shop and establishment will be able to remain open from 6 a.m. to 12 midnight.

As per the amendments to the Industrial Disputes Act, new establishments will get exemption from many provisions in the next 1,000 days and the exemption will be given to those industries who have made adequate provisions for the investigation and settlement of industrial disputes of the workmen employed by them.

Under the Factory Act, a production entity with 20 laborers instead of 10 with electric power and 40 workers instead of 20 without electricity shall qualify factory. This will exempt small industries from registration under the Factory Act.

Establishments employing less than 50 workers can be inspected only after the permission of the labour commissioner. Factories will have to file one return instead of two returns.

Further Online registration will be given in one day itself on applying online for registration under Factory Act 1948, Shop and Establishment Act 1958, Contract Labour Act 1970, Interstate Migrant Workers Act 1979, Motor Transport Workers Act 1961, Madhya Pradesh Building and Other Construction Workers Act 1996 and Beedi and Cigar Workers (Conditions of Employment) Act 1966.
