HC of Madras orders the Employees State Insurance Act to apply to aided and unaided educational institutions

The High Court of Madras through a judgement dismissing the petition filed by All India Private Educational Institutions Association ordered that the Employees State Insurance Act applies both to aided and unaided educational institutions. The petition was filed by the All India Private Educational Institutions Association challenging the order dated November 26, 2010 which provided for application of Employees State Insurance Act to both aided and unaided educational institutions.

The plea moved by the All India Private Educational Institutions Association alleged that the government had “discriminated” between government-aided and private unaided educational institutions. The issue was referred to the bench because conflicting Judgments was entered in the past by the High Court in the matter. The Bench dismissed the petition and validated the order dated November 26, 2010.
