Implementation of Transgender Rights Protection in Higher Education Institutions: Maharashtra State Directive

The notification pertains to the compliance of the State of Maharashtra with the Transgender Persons (Protection of Rights) Act, 2019 and related regulations in colleges and higher education institutions under the Department of Higher and Technical Education. The National Human Rights Commission’s circular dated 15th September, 2023 and the Department of Social Justice and Divorce Assistance’s order dated 11th March, 2024 are referenced in this context. The focus is on protecting and promoting the human rights of third party persons, addressing challenges they face, and ensuring the strict implementation of measures to safeguard their welfare and rights.

The notification outlines recommendations for the implementation of the National Register of Citizens-2020 to promote inclusiveness and equality, protect the rights of transgenders, and provide them access to higher education institutions. These recommendations include ensuring compliance with relevant rules and provisions, addressing issues of prejudice and harassment, setting up networks or cells to address harassment of transgenders, providing equal opportunities and respect for transgender persons in various aspects of social life, and appointing coordinating cells to provide comprehensive services for transgender interests. 

Additionally, the notification emphasizes the reservation of separate rooms for transgenders in hostels and the waiver of registration fees for examination programs under the Higher Technical Education Department’s purview.
