In Tamil Nadu, shops can now remain open for 24*7

The major highlights of the recent Bill passed by the Tamil Nadu Department of Labour and Employment on 6th June 2019, is that all shops and establishments, having more than 10 employees, can now operate for 24 hours on 7 days a week. The order will be effective for next three years.

All employees are entitled to one weekly holiday on rotational basis and no employee should work beyond 8 hours a day (excluding overtime). No employee can work for more than 10.5 hours a day and 57 hours a week, including over-timing, under any circumstance. If the employees are found working beyond normal duty hours or on holidays without proper indent for overtime, penal action shall be taken against the employer.

To ensure further safety to women, it is mentioned that women employees would not be required to work beyond 8 pm on any day “in normal circumstances.” The employer can allow her to work between 8 pm and 6 am only after obtaining a “written consent” from the woman staff. Transport arrangements shall be provided to women employees who work on a shift basis.
