The Registration and Licensing of Industrial Undertakings Rules, 1952 (hereafter referred to as the ‘Principal Rules’) has been amended vide a gazette notification dated 4th September, 2019.
As per the amendment the following changes have been, made to the Principal Rules:
- “Ministry of Industry (Department of Industrial Development)” or “Ministry of Industrial Development” shall be substituted with the words “Ministry of Commerce and Industry, Department for Promotion of Industry and Internal Trade”.
- The Central Government may, by notification in the Official Gazette, appoint one or more committees, consisting of such number of members as it may think fit, to represent the Ministries or Departments of the Central Government dealing with,—
- Department for Promotion of Industry and Internal Trade
- Industries specified in the First Schedule to the Act
- Home Affairs
- Commerce
- Corporate Affairs
However, the Central Government may, include in such committee, any other member to represent any other Ministry or Department.
3. Ministry of Commerce and Industry, Department for Promotion of Industry and Internal Trade, where decides that a licence or permission, should be granted, it shall inform the applicant accordingly, not later than five months (earlier it was 3 months) from the date of receipt of the application, or the date on which additional information has been furnished, whichever is later.
4. Where the Ministry of Commerce and Industry, Department for Promotion considers that certain conditions shall be attached to the licence or permission, or that the licence or permission should be refused, it shall not later than five months (earlier it was 3 months) from the date of receipt of the application or the date on which additional information has been furnished, whichever is later, give an opportunity to the applicant to be heard, before reaching a decision.
