The Competition Commission of India vide order dated May 11, 2020 has clarified that mere extension of an agreement for appointment of distributor does not constitute an exclusive distribution and promotion agreement under the provision of Section 3(1) of the Act. Thus it does not constitutes any unfair trade practice. It is also observed that state lotteries is as much amenable to the jurisdiction of competition regulator as any other private entity.
