The Directorate General of Foreign Trade vide its circular dated July 12, 2019, has shown concern regarding the casual behavior of Adjudicating Authorities in RAs and SEZs, governed by Foreign Trade (Development and Regulation) Act, 1992, while dealing with the pending appeals, review and recovery of penalty.
In order to clear the ambiguity, all Adjudicating Authoritiesin in RAs and SEZs, are informed that filing of appeal or review does not put stay on recovery unless a specific order has been made in that regard.
With this circular, the Adjudicating Authorities in RAs and SEZs are also directed to immediately recover all the pending penalties imposed by them and to submit a report to Directorate containing the details of all such cases along with action taken for recovery in each such case within 30 from the issue of the circular i.e., July 12, 2019.
