Draft Karnataka Educational Institutions (Issue of No Objection Certificate and Control) (Amendment) Rules, 2023

The Government of Karnataka has issued the Draft Karnataka Educational Institutions(Issue of No Objection Certificate and Control) (Amendment) Rules, 2023. These Draft Amendment Rules were issued on 7th February, 2023.

These Draft Amendment Rules seek to further amend the Karnataka Educational Institutions(Issue of No Objection Certificate and Control) Rules, 2022.

The Draft Rules empower the Deputy Director for Public Instruction (DDPI) to pass suitable orders granting renewal of No Objection Certificates.

Furthermore, every application for No Objection Certificate shall be received and DDPI to confirm its adherence to these rules, the Act and other applicable rules made there under. A site visit may be made by the concerned Taluka Block Education Officer (BEO) to confirm merits of the application prior to grant of NOC. Prior to the present draft amendment, these applications were verified by the BEO themselves.

Additionally, the Draft Amendment Rules contemplate that the Institution which furnishes for false information or document shall be liable for disciplinary action under the Act and the Code of Criminal Procedure, 1973 and the Institution shall not merely be de-recognised but also be debarred from seeking NOC for a period of 2 years.
