FSSAI issues clarification regarding non requirement of registration for delivery person and direct sellers

The Food Safety and Standards Authority of India (FSSAI) in its advisory dated 19th September, 2019 has issued direction regarding non-requirement of FSSAI registration of last mile delivery persons, direct sellers, food vending machines, water vending machines, food ATMs, branded food carts owned by single or main entity. FSSAI had received representations from the stakeholders in order to give clarifications on the order dated 8th June 2019.

The following clauses of the said order are clarified/Amended as below:

  1. The term “Direct Selling Agent” as mentioned in Para 1 and 2(i) of the order shall be read as “Direct Sellers”
  1. Para 3 of the previous order specifies the conditions for the entities which are not required to obtain an FSSAI registration. As per para 3(v) “Main entity shall issue ID cards vide digital or physical mode, bearing unique identity number and main entity or unit’s FSSAI license number.” It has been clarified that in case ID card does not have photo of the individual, it must be accompanied with a Government issued photo ID card.
  1. Under Para 3(viii), the Main entity is required to keep annual health records of all personnel working. It has been clarified that the Man entity will ensure that no such person known to be suffering from any contagious disease continues to handle food products.
  1. It has been clarified that the Order is applicable only where the main entity accepts the responsibility of regulatory compliance by last mile delivery persons, direct sellers, individual food units or entities etc. The main entity shall communicate in writing to its individual entities and to respective Licensing Authorities, its decision to undertake the responsibility of such compliance.
