Grant of Phase wise Paid Holiday on Poll Day in Karnataka

The Election Commission of India has officially announced the schedule for the General Elections to Lok Sabha 2024. The elections in the state of Karnataka are set to be conducted in two phases. The first phase will take place on Friday, 26th April 2024, and the second phase on Tuesday, 7th May 2024. Additionally, the by-election for the 36 Shorapur Assembly Constituency of Yadgiri district will also be held on 7th May 2024.

In accordance with Section 3-A of the Karnataka Industrial Establishments (National and Festival Holidays) Act, 1963 and Section 135 B of the Representation of the People Act, 1951, all employees working in shops, commercial establishments, factories, and other establishments are entitled to a paid holiday on the polling days. This provision is designed to facilitate the participation of all eligible workers who are voters in the constituencies where polling will be held on the said dates.

A press note was issued on 25th March 2024, stating that all employers are required to provide a paid holiday to their employees on the day of polling. However, there have been complaints from some trade unions and many workers that employers are not granting the paid holiday on the date of polling.

In response to these complaints, it is hereby informed that all employees of factories, shops, commercial establishments, and other establishments shall be granted a paid holiday for exercising their constitutional right to vote on the day of polling. Any violation of this provision will result in legal action against the concerned employer or organization.
