Karnataka Air (Prevention and Control of Pollution) (Amendment) Rules, 2024

The Government of Karnataka issued notification dated 10th January, 2024, regarding the amendment of the Karnataka Air (Prevention and Control of Pollution) Rules, 1983 and to be called as Karnataka Air (Prevention and Control of Pollution) (Amendment) Rules, 2024. The amended Rules shall come into force from the date of publication in the official Gazette.

The amendment primarily focuses on the consent fees for industries or organizations seeking consent to establish, expand, or operate, as well as for healthcare establishments, waste management activities, and projects where Diesel Generator Sets (DG Sets) are the sole source of air emission. The notification outlines the revised consent fees based on the capital investment and KVA rating of DG sets, providing a detailed table with corresponding fees for different categories.

The amendment lays down for the modification of Table I(a) and Table I(b) and the corresponding entries under these tables. The revised consent fees are structured based on the capital investment for different categories of industries or organizations, ranging from Rs.1 Lakh and below to exceeding Rs. 1000 Crores. Additionally, the consent fees for DG sets are specified based on their KVA rating, with varying fees per DG set per annum for consent to operate.

The procedure for payment of consent fees as per the new rules mentioned in the document involves online payment through a payment gateway, NEFT, or RTGS for government and PSUs. The consent fees are to be paid for various activities such as consent to establish, expand, or operate for industries or organizations, healthcare establishments, waste management activities such as STPs, CSTPs and CETPs, and projects where Diesel Generator Sets (DG Sets) are the sole source of air emission. The fees are structured based on the capital investment and KVA rating of DG sets, with specific amounts specified for different categories.
