MCA issues a warning to defaulting directors

The Ministry of Corporate Affairs on 1st November 2019, has announced in its website under the news and update column that Registrars of Companies’ are in the process of identifying and flagging directors who are in default of filing Annual returns or financial statements in the 2015-16, 2016-17 and 2017-18 financial years.

Companies will no be allowed to file e-form through MCA21 portal using the DIN of such directors in default. The Update cautions defaulting directors that statutory action will be initiated under Section 164 of Companies Act, 2013, if they fail to make necessary compliances before they are flagged.
