The Meghalaya State Electricity Regulatory Commission (MSERC) has released a notification announcing proposed amendments to its Conduct of Business Regulations, 2007. Issued on 5 November 2025, the draft—titled Meghalaya State Electricity Regulatory Commission (Conduct of Business) (First Amendment) Regulations, 2007 (4 of 2025)—aims to streamline the Commission’s internal functioning and bring more clarity to procedural aspects such as quorum and service of notices.
The Commission has invited public suggestions within 15 days from the date of the notification(NOVEMBER 5TH 2025) , prior to final publication in the Gazette of Meghalaya (Extraordinary). This move aligns with the regulatory mandate under Section 181(2)(zl), Section 92(1), and Section 93 of the Electricity Act, 2003.
Key Amendments Proposed
1. Change in Quorum Requirements (Regulation 10)
MSERC proposes to modify the quorum rules for Commission meetings and hearings:
- When the Commission consists of more than one Member, the quorum shall be two, including the Chairperson.
- If there is a vacancy or any defect in the constitution of the Commission, the quorum may be reduced to one.
This change ensures that essential regulatory work does not stall due to unforeseen vacancies and provides flexibility for decision-making during transitional periods.
2. Updated Methods for Serving Notices (Regulation 15)
The amendment expands the permissible ways of serving notices or processes:
- The Commission may now serve notices through electronic means or any other mode it deems appropriate.
This update reflects the need for modern, efficient communication channels in regulatory processes, enabling faster service and improved accessibility for stakeholders.
Public Participation Invited
MSERC has opened the floor for stakeholders—utilities, consumers, industry bodies, and the general public—to submit their suggestions or objections within the 15-day consultation window. This step underscores the Commission’s commitment to transparency and participatory regulation.
Once finalized, the amended regulations will come into force upon publication in the Gazette of Meghalaya (Extraordinary).
