MoRTH notifies Draft rules to fast track Hit&Run Accident investigations and settlement of claims with enhanced compensation.

The Ministry of Road Transport and Highways vide its notification dated 2nd August 2021 has amended Central Motor vehicle Rules, 1989 to mandate mobile numbers in the Certificate of Insurance.

The procedure for detailed investigation of road accidents, the Detailed Accident Report (DAR)and its reporting, along with timelines for different stakeholders, for quick settlements of claims by MACT (Motor Accident Claim Tribunal), have been mandated.

The Draft rules regarding creation, operation, and sources of fund, etc. of the Motor Vehicles Accident Fund have been notified and the fund shall be used for providing compensation in case of Hit &Run Accident, treatment for accident victims, and any other purpose, as may be specified by the Central Government.

Further a Motor Vehicle Accident Fund shall be constituted under the MV Act, and shall comprise of the following three accounts:

a. Account for Insured Vehicles;

b. Account for Uninsured vehicles/Hit and Run Accident; and

c. Hit and Run Compensation Fund.

In case of motor accidents caused by insured vehicles, the approved claim amount shall be disbursed by the designated agency to the Hospital from the Account for Insured Vehicles.
