State Government of Haryana prescribes qualification terms and conditions for Chairman and member secretary appointed under Haryana Water Pollution

The State Government of Haryana on November 20, 2019 has published the Haryana (Prevention and Control of Water Pollution) Rules, 2019, to further amend the Haryana (Prevention and Control of Water Pollution) Rules, 1978.

The amendment is brought under Rule 4 of Haryana (Prevention and Control of Water Pollution) Rules, 1978 which specifies the Qualifications and other terms along with the conditions of service of Chairman.

  • The chairman shall possesses Post Graduation degree in Science relating to environment or Degree in Engineering and has special knowledge and fifteen years of experience relating to environment protection, including industrial pollution mitigation or waste water treatment or air pollution control devices and has rendered twenty-five years of Government/Semi-Government service
  • The Chairman shall hold office for a term of 3 years from the date on which he assumes charge or till he attains the age of sixty-five years, whichever is earlier

Rule 4-A which specifies the Tenure and age Limit of Chairman has been omitted

The Educational and other qualifications along with pay, allowances and tenure of Member Secretary under Rule 16 has been substituted

Under Rule 23 which specifies the constitution, fee or salary, tenure procedure for hearings of Appellate Authority, Clauses (1), (5) and (6) has been substituted as follows:

  • The Appellate Authority shall consist of either a single person or three persons appointed by the State Government
  • The term for President and Members of the Appellate Authority shall be for a period of two years
  • The President and/or members of the Appellate Authority may hold office till sixty-seven years of age
  • The fee payable for filing an appeal under section 28 of the Act shall be as decided by the Government from time to time
