The decision is in line with the Rights of Persons with Disabilities (RPwD) Act, 2016 and aims to ensure stability, support, and dignity at the workplace.

The decision is based on Section 20(5) of the RPwD Act, 2016, which provides for the protection of employment rights and non-discrimination against PwDs in government service.

The exemption from routine transfers and rotational postings applies to the following categories:

1. Government Employees with 70% or More Disability

  • Fully exempted from routine or rotational transfers.
  • Allowed to continue at the same post after transfer or promotion, subject to administrative feasibility.
  • Posting should align with the type of disability to ensure optimal service utilization.

2. Employees with Children with Intellectual Disabilities

  • Exempted from rotational transfers.
  • Permitted to remain in their existing post or choose a preferred location, depending on administrative feasibility.

3. Caregivers of Family Members with Severe Disabilities

  • Employees who are primary caregivers to:
    • Daughter, son, spouse, parents, brother, or sister
    • Who have 70% or more disability (excluding intellectual disability)
  • Are also exempted from routine transfers, subject to administrative constraints.

The notification is based on recommendations from the Director, Department for Empowerment of Persons with Disabilities, Senior Citizens & Transgender Persons, and carries concurrence from the Finance Department (HRM.I).
