Andhra Pradesh Draft Electricity Regulatory Commission (Conduct of Business) Eight Amendment Regulations

The Andhra Pradesh Electricity Regulatory Commission (APERC) has issued a notification on 15 July, 2023 introducing the draft of Eighth Amendment to the Andhra Pradesh Electricity Regulatory Commission (Conduct of Business) Regulations, 1999. Under the proposed amendment, the Clauses governing subsidiaries have been removed from the existing regulations. The following provisions are removed:

“As per the regulations, the State Government may, at any time as it considers appropriate, propose any subsidy to any class or classes of consumers and upon receiving such proposal, the Commission shall determine the amount to be paid as subsidy, the terms and conditions of such payment including the time and manner of payment of subsidy amounts by the State Government.

While determining the tariff, the Commission shall take into account any subsidies, which the State Government had agreed to give to any class or classes of consumers. The tariff determined by the Commission shall be published duly taking into account such subsidy offered by the State Government as on the date of the decision of the Commission.(3) The licensee shall be required to furnish documents to the satisfaction of the Commission that the subsidy amount received by the licensee from the State Government is duly accounted for and utilized for the purpose for which the subsidy is given.”

The comments/suggestions/objections on the draft amendment, if any, may be sent by email to commn-secy@aperc.in or through postal mail to the Commission’s office in Hyderabad and the submissions should reach the designated person before 5th August 2023 to be considered by the Commission during the finalization of the amendment. Any submissions received after this date may not be taken into account.
