Assam Government Issues Public Notice Directing All Establishments to Constitute ICC Under POSH Act, 2013

The Government of Assam has issued a Public Notice directing all shops, commercial establishments, hotels, restaurants, factories, educational institutions, hospitals, NGOs and other private establishments in Kamrup (Metro) District with 10 or more employees to immediately constitute an Internal Complaints Committee (ICC) in accordance with the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.

The notice follows the Supreme Court’s Order dated 22.10.2024 in M.A. Diary No. 22553/2023 and is aimed at ensuring full compliance with the Labour Commissioner’s Office Order No. 220.

🔎 Mandatory ICC Composition

Every eligible establishment must constitute an ICC with the following structure:

1️⃣ Presiding Officer

  • A senior-level woman employee at the workplace.

2️⃣ Internal Members (Minimum Two)

  • Employees preferably committed to women’s welfare
    OR
    having experience in social work or legal knowledge.

3️⃣ External Member (One)

  • From an NGO/association working for women’s rights,
  • Must be familiar with issues related to sexual harassment,
  • Must not be an employee of the establishment.

Additional Requirements

  • At least 50% of ICC members must be women.
  • External member must be fully independent.

📌 Employer Obligations

  1. Display ICC details prominently at the workplace.
  2. Register the ICC on the official She-Box portal:
    https://shebox.wcd.gov.in/
  3. Submit compliance report to the Assistant Labour Commissioner, Kamrup (Metro), with:
    • ICC details
    • Name & contact information of the Nodal Officer

⚠️ Penalties for Non-Compliance

Failure to adhere to the POSH Act and the directions in the notice will be treated as a serious violation and may attract penalties, including a fine up to 50,000.
