Haryana Enables Online Exemptions for Factories to Boost Ease of Doing Business

In a significant move aimed at promoting industrial efficiency and reducing compliance burden, the Government of Haryana has announced a new online system for granting exemptions under the Factories Act, 1948.

This reform is part of the State’s commitment to the Ease of Doing Business (EoDB) and the Business Reform Action Plan (BRAP) and will affect working hours and rest intervals for adult workers in factories.

🔹 Key Highlights of the Notification:

  • Exemptions under Sections 55 and 65 of the Factories Act, 1948 will now be:
    • Delivered online
    • In auto-mode
    • Based on self-certification
  • Applicable only to factories with valid licenses under the Act.

🧾 Sections Covered:

  • Section 55 – Intervals for Rest
    Mandates rest intervals for workers after 5 hours of continuous work. Exemptions may now be claimed automatically online.
  • Section 65 – Power to Exempt from Rules
    Allows the state government to grant exemptions regarding working hours in special cases. This section is now included in the auto-mode exemption process.

The process includes:

  1. Login by the factory occupier with valid license details.
  2. Submission of self-certification under prescribed norms.
  3. Auto-issuance of exemption certificate without manual intervention.

🏭 Applicability

  • All factories registered under the Factories Act, 1948 in Haryana.
  • Occupiers must hold a valid license issued by the Labour Department.

⚠️ Mandatory Compliance

The notification further directs all factory occupiers and Labour Department officials to strictly adhere to these new procedural changes with immediate effect.

This means:

  • No manual or offline applications will be entertained for these exemptions.
  • Labour officials are instructed to recognize only online auto-issued certificates.
