The Government of Maharashtra has released an important notification outlining a comprehensive Standard Operating Procedure (SOP) to protect persons with disabilities (PwDs) from abuse, violence, and exploitation. Issued by the Disability Welfare Department on 13 November 2025, the decision aims to ensure strict implementation of Section 7 of the Rights of Persons with Disabilities Act, 2016.
The government emphasized its commitment to safeguarding the dignity and rights of PwDs, noting their higher vulnerability due to dependency and social barriers.
Key Highlights of the Government Notification
1. Competent Authorities Assigned
Under the Rights of Persons with Disabilities Act, the following authorities will take direct action on incidents of abuse or violence against PwDs:
- Sub-Divisional Magistrates (SDMs)
- District Magistrates (DMs)
They are empowered to:
- Take cognizance of complaints
- Provide protection and rehabilitation
- Initiate preventive and corrective measures
- Act under:
- Section 7, RPwD Act, 2016
- Rule 6, RPwD Rules, 2017
- Sections 133–143 of CrPC, 1973 (or Sec. 152–162 of the 2023 Indian Civil Security Code)
2. Complaint and Proceedings Mechanism
Who can file complaints?
- Victims or authorised persons with disabilities
- Police officers
- NGOs or organisations working for PwDs
- SDM/DM may also act suo moto
Procedure:
- Police must forward complaints to the SDM/DM.
- SDM/DM takes action under CrPC provisions.
- They may issue urgent interim orders and direct police/medical support.
- If the case falls under Section 92 of RPwD Act, it must be forwarded to the Judicial/Metropolitan Magistrate.
3. Scope of Action for Authorities
Upon receiving a complaint, the SDM/DM shall:
- Take immediate protective measures
- Issue interim directions in emergencies
- Ensure security, medical aid, rehabilitation, and assistance
- Remove any obstacles or nuisances affecting PwD rights
- Provide available legal remedies
Non-compliance with orders will attract penalties under Section 188 IPC (now Sec. 223 of the Indian Judicial Code).
4. Nature of Orders Issued
Orders by SDM/DM may include:
- Removal of barriers affecting rights
- Preventing harassment, bullying, or unlawful conduct
- Granting police protection or temporary custody
- Forwarding cases requiring criminal trial per RPwD Act
5. Reporting and Monitoring Mechanism
To ensure strict enforcement, a tiered reporting structure has been established:
Monthly Reports
- SP/Police Commissioner, SDM, and DM must submit reports to the District Disability Committee.
- The District Committee will then submit the district-level report to the State Disability Commissioner.
Quarterly Reports
- The State Disability Commissioner will analyse district data and submit a consolidated report to the state government every quarter.
All reports must follow the prescribed format and annexures.
