Private Bill introduced in Parliament to ensure 9-months salary as severance pay for employees terminated without due cause

A private member bill titled The Terminated Employees (Welfare) Bill, 2020 has been recently introduced in the Parliament to provide for the welfare measures for the employees who have been terminated by the employers without any fault on their part.

The Bill proposes to provide the terminated employees with assured income for nine months or till the time he gets employed elsewhere, whichever is earlier.

The Act shall not apply to employees who has been terminated for proven misconduct, cheating, fraudulent behavior or  who have been found guilty by a criminal court of justice.

The employment shall be terminated for reasons like winding up of the organization or the establishment due to economic slowdown, change in technology in the respective field, the owner or director managing the affairs of the establishment becoming insolvent,  change in Government policy, etc. Under such circumstances the employees shall be entitled to such unemployment compensation, health insurance benefits and any other benefits as may be prescribed by the Central Government, if such benefits are not part of the employee-employer agreement, for nine months or till the time he gets employed elsewhere, whichever is earlier.
